DE-ESKALASI PERDAGANGAN DAN EKSPLOITASI ANAK SECARA DARING DI ERA PANDEMI COVID-19 DALAM OPTIK HUKUM TELEMATIKA

Abstract


Perlu diakui, bila pemanfaatan internet saat ini tidak hanya menunjang terjadinya pelecehan serta objektifikasi anak, namun turut berkontribusi atas lahirnya modus baru yang meningkatkan commercial sexual exploitation (CSE) terhadap anak hingga melahirkan kesenjangan kronis terhadap perlindungan anak secara global. Pandemi Covid-19 yang berlangsung sejak 2019 menjadi salah satu faktor penyebab terjadinya eskalasi kerentanan anak sebagai korban perdagangan manusia dengan tujuan eksploitasi seksual, karena dampaknya telah memicu tingginya angka kemiskinan serta meningkatnya anak yang kehilangan orang tua. Intensitas anak menggunakan internet yang panjang selama pandemi telah turut meningkatkan peluang terjadinya CSE melalui media sosial serta aplikasi pesan. Tulisan ini berupaya mengurai beberapa enigma yang diakibatkan oleh pemanfaatan internet serta menemukan faktor penyebab rentannya anak menjadi korban CSE di era pandemi covid-19 hingga memberikan alternatif kebijakan yang komprehensif guna mewujudkan ekosistem digital yang ramah dan aman bagi anak. Penelitian ini merupakan penelitian yuridis normatif dengan pendekatan perundang-undangan serta perbandingan hukum. Hasil penelitian menemukan bila saat ini anak-anak semakin rentan untuk menjadi korban perdagangan anak untuk dieksploitasi seksual secara daring. Pandemi Covid-19 telah mendorong para pelaku perdagangan manusia melakukan langkah evolutif guna merubah modus operandinya dengan memanfaatkan penggunaan internet, tidak hanya memfasilitasi transaksi perdagangan seks, namun turut memanfaatkan ketidakberdayaan, ketergantungan serta kebiasaan oversharing anak pada internet. Mengacu pada gagasan bila perlindungan hukum wajib hadir pada ruang maya maupun nyata, maka diharapkan upaya pencegahan ini dapat terkonfigurasi sebagai langkah de-eskalasi bahkan memutus rantai perdagangan manusia dengan tujuan eksploitasi seksual di dunia maya, dan mendorong pemanfaatan internet menjadi media penanggulangan sexual abuse material secara daring
