Retraction Policy

Ius Scientia: Jurnal Ilmu Hukum is committed to maintaining the integrity, accuracy, and reliability of the scholarly record. The journal may retract a published article when there is clear and substantial evidence that the article contains serious problems that undermine its validity, integrity, or compliance with publication ethics.

Retraction is considered an exceptional editorial action and is undertaken only when necessary to correct the scholarly record and protect the integrity of academic publishing.

1. Grounds for Retraction

An article may be considered for retraction when there is reliable evidence of one or more of the following:

  • Significant errors or invalid findings that substantially affect the validity of the article;
  • Fabrication or falsification of research data, findings, evidence, or other scholarly materials;
  • Plagiarism, substantial text duplication, or unauthorized use of another person's intellectual work;
  • Duplicate or redundant publication;
  • Serious violations of research ethics or publication ethics;
  • Improper or undisclosed manipulation of data, figures, citations, or other scholarly materials;
  • Serious authorship disputes or unauthorized changes in authorship that cannot be resolved appropriately;
  • Undisclosed conflicts of interest that substantially affect the interpretation or credibility of the article;
  • Use of fraudulent, fabricated, or unverifiable sources or references;
  • Material violations of copyright, confidentiality, or other legal and ethical requirements; or
  • Other circumstances that provide compelling evidence that the published article is fundamentally unreliable or seriously violates the journal's ethical standards.

2. Retraction Procedure

A concern regarding a published article may be raised by authors, readers, reviewers, editors, institutions, or other interested parties.

When a credible concern is received, the Editor-in-Chief and/or the editorial team will conduct a preliminary assessment of the matter. Where necessary, the authors will be given an opportunity to provide an explanation or relevant supporting evidence.

Depending on the nature of the concern, the journal may request additional information from the authors' affiliated institutions or other relevant parties. The journal will assess the available evidence objectively and fairly before making a final editorial decision.

If the evidence establishes that retraction is warranted, the Editor-in-Chief will authorize the publication of a formal retraction notice.

3. Retraction Notice

A retracted article will remain part of the journal's published record whenever possible. The article will be clearly identified as “Retracted”, and a retraction notice will be published and linked to the original article.

The retraction notice will clearly state:

  • The title and authors of the retracted article;
  • The bibliographic information of the article;
  • The reason(s) for the retraction;
  • The date of the retraction; and
  • Any other information necessary to explain the action and preserve the transparency of the scholarly record.

The original article will not normally be removed from the journal's website or digital archive, except where removal is legally required or necessary to address exceptional circumstances. Where appropriate, the original article may be watermarked or otherwise clearly marked as “Retracted”.

4. Retraction and Author Responsibility

Authors remain responsible for the accuracy and integrity of their published work. If authors discover a significant error or ethical issue in their published article, they are expected to promptly notify the editorial office.

The journal encourages authors to cooperate fully with any investigation concerning the integrity of their work.

5. Retraction Does Not Constitute Punishment

Retraction is primarily intended to correct the scholarly record rather than to punish authors. However, where misconduct is established, the journal may take additional measures in accordance with its publication ethics policies.

Such measures may include notification of the relevant author's institution, rejection of other manuscripts submitted by the same author(s), or other appropriate editorial actions, depending on the seriousness of the violation.

6. Corrections and Retractions

Not every error requires retraction. Where an error is minor and does not substantially affect the validity or interpretation of the article, the journal may publish a Correction or Erratum instead.

Retraction will generally be considered when the reliability, integrity, or validity of the published article is substantially compromised.

7. Post-Publication Review

Ius Scientia: Jurnal Ilmu Hukum welcomes responsible post-publication communication concerning the accuracy and integrity of published research.

Readers and researchers who identify substantial concerns regarding a published article are encouraged to contact the editorial office and provide sufficient evidence to support their concerns.

All allegations will be handled confidentially and assessed in accordance with principles of fairness, due process, confidentiality, and academic integrity.

8. Editorial Independence

Retraction decisions are made independently by the editorial team based on documented evidence and applicable publication ethics standards. The journal does not retract articles solely because of disagreement with an author's academic interpretation, legal argument, theoretical perspective, or scholarly conclusion, provided that the article complies with applicable ethical and academic standards.
