Implementasi Pencegahan Transaksi Gharar Dengan Pelayanan Return Pada Platform E-Commerce Shopee

Abstract


Tujuan Penelitian: Menganalisis konsep gharar dalam transaksi e-commerce Shopee dan mengevaluasi efektivitas kebijakan return dalam perspektif ekonomi syariah.

Metode: Menggunakan observasi, studi literatur, dan wawancara terhadap 20 responden yang pernah melakukan return barang.

Originalitas/Novelty: Pendekatan syariah terhadap praktik gharar di e-commerce dengan fokus pada ketidaksesuaian produk dan mekanisme return sebagai solusi.

Hasil Penelitian: Ketidakjelasan deskripsi produk berpotensi menimbulkan gharar, menyebabkan ketidakpuasan konsumen, sementara kebijakan return Shopee masih menghadapi kendala seperti prosedur rumit dan waktu pemrosesan lama.

Implikasi: Diperlukan perbaikan transparansi informasi, penyederhanaan proses return, dan penerapan mekanisme kompensasi parsial (arsy) untuk meningkatkan keadilan transaksi sesuai prinsip syariah, sehingga platform e-commerce dapat lebih beretika dan bebas gharar

Research Objective: This study aims to analyze the concept of gharar in Shopee's e-commerce transactions and evaluate the effectiveness of its return policy from an Islamic economics perspective.

Methodology: The research employs observation, literature review, and interviews with 20 respondents who have experienced product returns.

Originality/Novelty: The study offers a Shariah-based analysis of gharar in e-commerce, particularly focusing on product discrepancies and return mechanisms as solutions.

Findings: The research reveals that unclear product descriptions may lead to gharar, resulting in consumer dissatisfaction. While Shopee's return policy provides consumer protection, its implementation faces challenges such as complex procedures and lengthy processing times.

Implications: The study recommends improving information transparency, simplifying return processes, and implementing partial compensation (arsy) mechanisms to enhance transactional fairness in accordance with Shariah principles, thereby promoting more ethical and gharar-free e-commerce practices.
